No arbitrator shall be of the nationality of the place of incorporation or principal place of business of any of the parties or their shareholders.
For the purpose of this Article, a person who is a citizen of two or more States shall be treated as a national of each state; and citizens of the European Union shall be treated as nationals of its different Member States and shall not be treated as having the same nationality. The seat, or legal place, of arbitration shall be Germany.
The language to be used in the arbitral proceedings shall be German. All written submissions shall be made in the German language. All evidence, including all witness statements, shall be submitted in the German language, or with a translation into the German language. Oral testimony shall be in the German language or shall be simultaneously translated into the German language by a translator. Each party shall bear its own translation costs.
